Vender Xpress Privacy Policy

Vender Xpress respects the privacy of its customers, website visitors, prospective customers, site hosts, event organisers, contractors and other individuals who interact with the business.

This Privacy Policy explains how Vender Xpress collects, holds, uses and discloses personal information through:

  • the Vender Xpress website;

  • quote and contact forms;

  • machine orders and purchases;

  • vending placement applications;

  • event enquiries and bookings;

  • customer accounts;

  • payment and delivery processes;

  • managed vending machines, pods and trailers;

  • analytics, advertising and communications systems; and

  • other interactions with Vender Xpress.

Where the Privacy Act 1988 (Cth) and the Australian Privacy Principles apply to Vender Xpress, Vender Xpress will handle personal information in accordance with those requirements.

Camera footage

Some managed machines, pods, trailers or sites may use security cameras.

Where cameras are used, footage may capture a person’s image, movements or interactions near the equipment. Camera footage may be used for:

  • security;

  • theft and vandalism prevention;

  • protecting customers, staff and equipment;

  • investigating incidents;

  • resolving disputes;

  • fraud prevention; and

  • responding to lawful requests.

Vender Xpress does not use camera footage for facial recognition, biometric profiling or targeted advertising.

Camera signage will be displayed where reasonably practicable.

 

4. How we collect personal information

  • partial or masked card information.

Vender Xpress does not intend to directly store complete payment-card numbers, card security codes or online banking passwords.

Payment providers handle payment information under their own terms and privacy policies.

 

8. Marketing communications

Vender Xpress may send product updates, offers, announcements or other marketing communications where:

  • the person has consented;

  • consent can reasonably be inferred where legally permitted; or

  • the communication is otherwise permitted by law.

Marketing consent should be collected using a separate, optional checkbox. Submitting an ordinary enquiry should not automatically subscribe someone to marketing.

Marketing messages will identify Vender Xpress and provide a way to unsubscribe. Unsubscribe requests will be processed as required by applicable law.

Australian commercial email and SMS rules generally require consent, sender identification and a functional unsubscribe method. ACMA also warns against automatically adding one-off enquirers to marketing lists without consent.

  • advertising platforms;

  • professional advisers;

  • insurers;

  • a purchaser or adviser involved in a proposed sale, restructure or transfer of the business.

We will seek additional consent where required, including before providing personal information to an equipment-finance provider for a finance application.

Machine suppliers may receive product specifications, configuration requirements and manufacturing information. Vender Xpress does not ordinarily provide overseas machine suppliers with customer-identifying information.

We do not sell customer personal information to advertisers.

 

10. Overseas processing and disclosure

Some third-party providers used by Vender Xpress operate outside Australia or use international data infrastructure.

Personal information may therefore be stored, processed or accessed in countries including:

  • the United States;

  • Israel;

  • Ireland;

  • South Korea;

  • Taiwan;

  • Singapore; and

  • other countries in which our service providers or their subcontractors operate.

For example, Wix states that site visitor information may be stored in data centres in the United States, Ireland, South Korea, Taiwan and Israel. Other analytics and advertising providers also transfer or process information internationally.

Where applicable, Vender Xpress will take reasonable steps concerning overseas handling in accordance with Australian privacy requirements.

 

11. Data security

Vender Xpress takes reasonable steps to protect personal information against:

  • misuse;

  • interference;

  • loss;

  • unauthorised access;

  • unauthorised modification; and

  • unauthorised disclosure.

Measures may include:

  • multi-factor authentication;

  • restricted account access;

  • secure payment providers;

  • staff or contractor access controls;

  • software updates; and

  • secure deletion or de-identification.

No website, transmission or storage method is completely secure. Affected individuals and relevant regulators will be notified where a data breach must be reported under applicable law.

 

12. Retention of personal information

Vender Xpress retains personal information only for as long as reasonably necessary for its business, contractual, safety, warranty, accounting and legal purposes.

Our intended retention periods are:

Unsuccessful enquiries

General enquiries that do not result in a sale, placement, event booking or ongoing relationship will generally be deleted or de-identified 12 months after the last meaningful contact.

Unsuccessful placement applications

Site applications, photographs and related assessment information will generally be deleted or de-identified 12 months after the application is closed, unless the applicant asks us to retain the application for future consideration.

Customer and transaction records

Orders, invoices, payments, accounting records and related transaction information will generally be retained for at least five years, or longer where required by law, a dispute, warranty claim or contractual obligation.

Warranty and service records

Warranty, maintenance and repair records may be retained for the warranty period and for a reasonable period afterwards to manage claims, recurring faults, safety matters and legal obligations.

Customer accounts

Account information may be retained while the account is active and for up to 12 months after closure, except where related transaction, warranty or legal records need to be kept longer.

Camera footage

Routine camera footage will generally be retained for up to 30 days.

Footage connected with theft, vandalism, safety incidents, disputes, insurance claims, legal proceedings or law-enforcement requests may be retained for longer while it remains relevant.

Machine telemetry

Identifiable machine telemetry may generally be retained for up to 24 months, or for the duration of the customer or site relationship. It may then be deleted, aggregated or de-identified unless it remains necessary for safety, warranty, fraud prevention, reporting or legal purposes.

Analytics and advertising information

Analytics and advertising information is retained according to the settings and policies of the relevant provider. Vender Xpress will periodically review these settings and avoid retaining identifiable information longer than reasonably required.

Marketing opt outs

Minimal information needed to honour an unsubscribe request may be retained for as long as necessary to ensure the person is not unintentionally re-added to marketing communications.

When information is no longer reasonably required, Vender Xpress will take reasonable steps to delete or de-identify it, unless its retention is required by law.

 

13. Accessing or correcting personal information

A person may request access to personal information Vender Xpress holds about them or ask for inaccurate, incomplete or outdated information to be corrected.

15. Data breaches

If Vender Xpress becomes aware of a suspected data breach, it will assess the incident, take steps to contain it and determine whether notification is required.

Where applicable, affected individuals and the Office of the Australian Information Commissioner will be notified if an eligible data breach is likely to result in serious harm.

 

16. Third party websites and services

Our website may contain links to third-party websites, finance providers, payment providers, social-media platforms, freight companies or other services.

Vender Xpress is not responsible for how those third parties collect or handle personal information. Individuals should review the relevant third party’s privacy policy before providing information.

 

17. Children’s privacy

The Vender Xpress website and services are intended primarily for businesses, commercial customers, site representatives and event organisers.

We do not knowingly seek to collect personal information directly from children. Where we become aware that personal information has been provided by a child without appropriate authority, we may delete that information where reasonably practicable.

 

18. Automated decision making

Vender Xpress does not currently use personal information in an automated decision-making system that makes decisions reasonably expected to significantly affect an individual’s rights or interests.

If this changes, this Privacy Policy will be updated to explain the types of personal information used and the kinds of decisions made.

 

19. Changes to this Privacy Policy

Vender Xpress may update this Privacy Policy as its products, services, technology or legal obligations change.
